According to TMZ, a representative for 40/40, Ron Berkowitz, stated that one of the refrigerator engines blew before health inspectors arrived causing temperatures in the fridge to rise. Kitchen staff detected the problem immediately and had no intention of using the food from the broken Frigidaire. Still, inspectors hit the club with several violations forcing them to close their doors. Repairs were made by noon the next day and Berkowitz says the club has lost no business due to the violations and a new health grade is pending.
